Update on Clinical Lab Anti-Kickback Issues

In a prior article we addressed ongoing disputes in the Clinical Laboratory industry over the effect of state and federal anti-kickback statutes and rules. (See “Laboratory Battle Brewing Over Proposed Anti-Kickback Rule Amendment.”) At issue is the ability of laboratories to supply staff, such as phlebotomists, and supplies to physician practices to assist in specimen collection.

The Agency for Health Care Administration (AHCA) has announced a Rule Workshop on the Anti-Kickback issues for Clinical Laboratories to be held in Tallahassee on March 10, 2010 at 2:00 p.m.
